Book 3, Chapter 11 — The Death of the Body Politic
Every body politic, like every human body, carries the causes of its destruction from the moment it is born.
Summary
The chapter opens with a note of political mortality that cuts against every utopian reading of the book. If Sparta perished and Rome perished, no state can hope to last forever. The task of political art is not to create eternal institutions but to give a state the best constitution so that it lasts longer than it otherwise would — not to prevent death but to delay it and ensure a dignified one.
Rousseau's anatomical metaphor structures the argument. The body politic's life-principle is its sovereign authority. The legislative power is the heart: when it stops, the state is dead. The executive power is the brain: it can be paralyzed — a state can have a failing government — and the body survives. This asymmetry is crucial: Rousseau is not indifferent to good government, but he is clear that it is the sovereign people's capacity to legislate that is the irreplaceable organ.
The chapter closes with a reflection on the law's relation to time. Yesterday's law is not binding today — its force comes from the continuing tacit consent of the sovereign, which is assumed unless revoked. Old laws that survive do so because the sovereign has implicitly continued to will them; laws that grow weak as they age reveal that the legislative power is dying. The vitality of a republic's laws is its most accurate health indicator. Wherever laws gain strength with age, the sovereign lives; wherever they decay, it is already gone.
