Terms of Service

1. The service

Tinct is a reading platform for classic and public-domain literature, operated by Anders K. Hvelplund, Copenhagen, Denmark (contact@tinct.app). It offers editions of texts, audio narration, reading tools and AI features: a reading companion you can chat with, and Talk, a voice conversation. We may change features over time. If a change materially reduces what you've paid for, we'll tell you in advance and you may cancel.

2. Who can use Tinct

Anyone can read the public library, at any age, without an account.

Accounts: you need to be at least 13 to create an account. If you're under 18, a parent or guardian must agree to these terms with you.

Paying: only an adult can buy a subscription or a top-up. A parent or guardian can pay for a younger reader's account.

AI features: chat, Talk, explanations and recaps are for readers aged 18 and over. Tinct's AI providers set their own rules for younger users, and we follow the strictest of them.

You're responsible for keeping your login details safe and for everything that happens under your account. A parent or guardian is responsible for how a younger reader uses Tinct.

3. Subscriptions, AI use and payment

Subscriptions are billed in advance through Stripe and renew automatically until you cancel.

Premium includes a monthly amount of AI use, shown as a bar in the app. It resets every month on the day your subscription started and doesn't roll over. When it runs out, your account works like a standard account until it resets: you can still read and listen, and AI chat, Talk and recaps pause. You can buy a top-up to keep using them. Top-ups don't expire and stay yours if you leave Premium.

Top-ups have no cash value and can't be transferred or refunded, except where the law requires it.

We'll give at least 30 days' notice by email before a price change.

EU right of withdrawal: you normally have 14 days to withdraw. When you start using Premium or a top-up, you ask us to begin providing it straight away. You lose the right of withdrawal for content that has been fully delivered, and a withdrawal from a service already in progress may be reduced in proportion to what you've used.

4. Your content and your responsibility for it

"Your content" means anything you put into Tinct: notes, highlights, journal entries, messages and voice input to the AI features, any text or file you upload or import, and the name you set on your profile.

You own your content. You give Tinct a limited licence to store and process it only so we can run the service for you. We don't use it to train AI models.

You are solely responsible for your content. You confirm you have every right needed to upload it and to use it in Tinct, including asking the AI features about it and having it read aloud, including copyright and privacy rights, and that doing so doesn't break any law. Tinct does these things only on your instruction and only for you. You are responsible for what you upload and for what you share from Tinct. Tinct stores your own files privately and only for you; to the fullest extent the law allows, Tinct is not liable for your content. We act on notices of infringing or unlawful content (see Reporting and removal below), and accounts that repeatedly upload such content are closed.

Don't upload content that infringes someone else's rights, is unlawful, contains other people's personal data without a lawful basis, or tries to attack the service or its AI features.

If you add your own books, the AI features process their text on your instruction and only for you. Keep a lawful copy of any book you add.

Your profile. You are responsible for your profile name. Don't pretend to be someone else or choose anything hateful or sexual. We may rename or hide a profile that breaks these rules. You can block or report a reader; see Reporting and removal.

If someone makes a claim against Tinct because of your content or your breach of these terms, you compensate us for the loss and reasonable costs you are responsible for under the general rules of Danish law.

Reporting and removal

To report content you believe infringes your rights or is unlawful, write to contact@tinct.app, or use the report link in the app where available. We review each report and may remove or restrict the content. If we do, we tell the person who uploaded it why, and they can reply to object. People, not automated systems, review reports and make these decisions.

5. AI features: no guarantee of accuracy

AI answers can be wrong. They may be inaccurate, incomplete or invented while sounding confident. This includes quotations, dates, translations and interpretations.

Tinct is not responsible for the content or accuracy of AI answers. They come from third-party AI models, and they aren't Tinct's statements or views.

They aren't medical, legal, financial, psychological, religious or any other professional advice.

Check anything that matters against the text and reliable sources. You are responsible for how you use AI answers, including under your school's rules on AI.

6. The public library and Tinct's materials

If you're reading from outside the US and EU, you're responsible for checking that a text is in the public domain where you are. Tinct's modern editions, introductions, narration, design and software belong to Tinct. You may use them for your own reading, but you may not copy, scrape, redistribute or resell them, or use them to train AI models. Modern editions and narration are prepared with AI and editorial review, so they may contain errors. Please report any you find.

7. Acceptable use

Don't share or resell your account, use bots or scrapers, get around usage limits or payment, or use the AI features to produce unlawful or harmful content.

8. Suspension and termination

You can delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, with a warning first where that's reasonable.

9. Disclaimers and limitation of liability

The service is provided "as is". As far as the law allows, Tinct isn't liable for indirect losses or for losses that result from relying on AI answers, from your own content or from what other readers add, and our total liability is limited to what you paid us in the past 12 months. This does not apply to losses we cause intentionally or by gross negligence. Nothing here limits liability that the law doesn't allow us to limit, or your mandatory rights as a consumer.

10. Changes, law and disputes

We'll email you at least 30 days before material changes to these terms. Danish law applies. EU consumers keep the protection of their own country's mandatory laws, and can complain to Nævnenes Hus or through the EU's online dispute resolution platform.
